Felons are NOT allowed into the military any more than Family Violence Offenders due to the Lautenburg Amendment to the Gun control act of 1968

  • The Act bans shipment, transport, ownership and use of guns or ammunition by individuals convicted of misdemeanor or felony domestic violence, or who is under a restraining (protection) order for domestic abuse. The Act also makes it unlawful to sell or give a firearm or ammunition to such person.

Commentary

Lautenberg was enacted to diminish escalation of domestic violence in our country. An unfortunate (an unintended) consequence is it's effect on our military and many soldiers have had to get out because of it. I have represented some of these soldiers as a military attorney. Because the military has its own problem with domestic violence there is no likely change/exception to Lautenberg.

Recruiters would love to bring guys like your nephew in but there hands are tied. Yes it seems confusing that you can get in with other crimes (including assaults that are not domestic in nature) but it's out of the recruiters' hands.

Only thing you can do is get congress to change the law. I don't see it happening as domestic violence is a hard thing to argue against. 20 hours ago

Can someone with a misdemeanor record may enlist in the U. S. Armed Forces?
